Arkansas Attorney General Leslie Rutledge has stated that she believes current law in Arkansas allows people to carry handguns openly.
“I interpret it to mean an individual may carry so long as he or she does so without the intent to unlawfully employ it against another person,” Rutledge said in a prepared statement. “But anytime law enforcement and citizens disagree on a law we need to ensure there is clarity to protect our citizens.”
People need to understand, while “Open Carry” is legal, there are still places where it is illegal to carry a firearm, such as at a school. We encourage everyone who plans on carrying a firearm to know where you can and cannot carry. Although Local law enforcement supports the Constitution and the Rights of Citizens they do, however, understand that people walking around with guns in public can cause people to be alarmed. If local law enforcement is notified of “a person with a gun”, they must respond to investigate the situation. A responsible Gun Owner/Citizen should recognize this fact and be respectful while the officer does his job.
This law has also been considered to mean “One may openly carry a weapon how they choose”, meaning Open Carry or to Concealed Carry, with the majority to choose to keep their weapon concealed. It is believed that Arkansas has up to 100,000+ citizens practicing this option on a daily basis, throughout the state either with or without a state issued permit.
An Arkansas State Conceal Carry Permit can be purchased only by the Arkansas State Police, whom do not recognize “Act 746” as law and may be more aggressive during a field investigation of an armed citizen.
